ALPSE PTE. LTD. ("ALPSE," "we", "us" or "our") maintains these Terms of Service ("Terms") that describes the terms and conditions applicable to the use of our game applications for mobile devices. By installing, accessing or using the ALPSE Services (as defined below) you explicitly agree with the terms and conditions of this terms. If you don't agree to these Terms, then you have no right to access or use the ALPSE Services.

The "ALPSE Services" means (i) the websites, and (ii) any other application, game, service, product, feature or content of ALPSE or its licensors licenced , downloaded, or otherwise assessed by you through any third party website, platform or source. The ALPSE Services also include updates and upgrades as well as accompanying manuals and documentation, and all copies thereof.

EACH TIME YOU ACCESS OR USE ALPSE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS, AND REPRESENT THAT YOU HAVE READ AND UNDERSTAND THE APPLICABLE RIGHTS, OBLIGATIONS, TERMS AND CONDITIONS SET FORTH HEREIN AND THEREIN AND AGREE TO BE LEGALLY BOUND BY THEM. IF YOU DO NOT UNDERSTAND OR AGREE TO BE BOUND BY THESE TERMS, DO NOT ACCESS OR USE ALPSE SERVICES.

1. Modification
ALPSE reserves the right, at its sole discretion, to modify, discontinue or terminate all or any of the ALPSE Services, including any portion thereof, or to modify these Terms, at any time and without prior notice. If we modify these Terms , we will post these Terms as modified or otherwise provide you with notice of the modification. By continuing to access or use the ALPSE Services after we have posted a modification to these Terms or have provided you with notice of a modification, you are indicating that you agree to be bound by the modified Terms. If the modified Terms is not acceptable to you, your only recourse is to cease using the ALPSE Services.
2. Eligibility
Those who wish to register as members of the ALPSE Services must understand and agree to the Terms before registering as a member of the ALPSE Services.
You agree that if you are under the age of 18 or whatever is the age of legal majority where the area to live in, you represent that your legal guardian has read, understood, and agreed to these Terms.
In registering for Approval and Account, you agree to monitor and restrict any use of the ALPSE Services by minors. You accept full responsibility for any unauthorized use of the ALPSE Services by minors, and this includes any use of your credit cards or other payment or settlement instruments or devices by minors.
You may not register for Approval or Account if you are below the age of 13. In registering for Approval and Account, you agree to prevent access to anyone under 13. Since the ALPSE Services are not intended for children under the age of 13 ("children"), access to the ALPSE Services or issuance of Account is not knowingly granted to children.
If you are issued a password, you are responsible for safeguarding your password. You agree not to disclose your password to any third party or to allow any third party to use your Account, and you agree to take sole responsibility for any activities or actions under your Account, whether you have authorized such activities or actions. In the event of loss of your password, you agree that you will solely be responsible for any missing items related to the ALPSE Services.
You shall refrain from using, accessing, downloading, or otherwise exporting, or transferring the Online Services in violation of applicable export control, economic sanctions, and import laws and regulations, including, but not limited to, the U.S. Export Administration Regulations, Specially Designated Nationals and Blocked Persons List, and related regulations promulgated by the U.S. Department of the Treasury's Office of Foreign Assets Control. You represent and warrant that You are not subject to any such prohibitions.
3. License
Subject to your compliance with these Terms, ALPSE hereby grants you a limited, non-exclusive, non-transferable, non-sublicensable license to, in ordinary and reasonably foreseeable ways, access, view, download and print, where applicable, the ALPSE Services solely for your personal and non-commercial purposes. The ALPSE Services is our copyrighted work or the copyrighted work of our licensors or licensees, and all trademarks, service marks, trade names and other intellectual property rights in the ALPSE Services are owned by us or our licensors or licensees. We retain full and complete ownership of the ALPSE Services. ALPSE does not assign to you all rights in any interim portion of the ALPSE Services.
4. Intellectual Property
ALPSE, its licensors and/or certain third parties (as applicable) retain exclusive right, title and interest (including all intellectual property rights) in and to all materials that are part of the ALPSE Services (including past, present and future versions) (excluding User Content), including, without limitation: graphics; layout; text; images; audio and/or video; designs; advertising copy; logos; domain names; trade names and marks; and service marks; any and all copyrightable material; the compilation, assembly and arrangement of the materials of the Applications; and all other materials or content made available on the Applications (collectively, the "ALPSE Materials") and such ALPSE Materials are protected from unauthorized use, copying and dissemination by copyright, trademark, patent, publicity and other laws, rules, regulations and international treaties.
If you provide ALPSE with any feedback, bug reports, or suggestions for improvements ("Feedback"), you hereby assign to ALPSE all rights, title, and interest in and to such Feedback.
ALPSE shall be entitled to use the Feedback for any purpose without restriction, compensation, or notification to you. To the extent permitted by applicable law, you hereby irrevocably waive and agree never to assert any rights that you may have in such Feedback in any jurisdiction.
5. User Content and Communication
ALPSE has the right, but not the obligation, to monitor or record your online activities and communication within the ALPSE Services (including text and voice chat). While ALPSE respects the "secrecy of communication" in accordance with Article 4 of the Telecommunications Business Act of Japan, by using these features, you provide your irrevocable consent to such monitoring for safety and compliance purposes.
We reserve the right to review, monitor, prohibit, edit, delete, or disable access to any User Content without notice. You acknowledge that ALPSE may disclose your communication data or metadata to law enforcement or government authorities if required by applicable local laws (such as the Electronic Communications Privacy Act or GDPR) or when ALPSE deems it necessary to protect the safety, rights, or property of ALPSE, its users, or the public.
6. Fees and Withdrawal
You must pay the applicable fee for each the ALPSE Services and any available Virtual Items.
In addition to the foregoing, you hereby acknowledge and agree that you shall solely be responsible for and bear all telecommunication expenses, including, telephone charges, Internet connection charges and electricity charges, arising out of your access and use of ALPSE Services.
Any dispute arising between you and any third party payment process service (including a credit card company) shall be resolved directly between you and such third party. To the full extent permitted under applicable law, ALPSE shall not be liable for any obligations incurred by you to such third party in connection with your access and use of ALPSE Services. You agree to indemnify, defend and hold harmless ALPSE, its licensors, affiliates, employees, officers, and directors from all claims for liabilities, losses and expenses, including reasonable attorneys' fees, from third parties arising from such disputes.
Without limiting any other remedies, we may limit, suspend, terminate, modify or delete your access and use of ALPSE Services (or any portion thereof) at any time if you are, or we suspect that you are, failing to comply with any of with or without notice to you.
  • 1) If a person under the age of 18 or whatever is the age of legal majority where the area to live in does not have consent to a legal representative.
  • 2) If you have been disqualified from membership in the past.
  • 3) If a member violates the Terms.
  • 4) If ALPSE deems it inappropriate.
If ALPSE terminates your access to ALPSE Services, you may lose your Account as well as any benefits, privileges, Virtual Items and User Content associated with the subject ALPSE Services, and we are under no obligation to compensate you for any such losses or results.
All fees and charges you incurred in purchasing virtual items are non-refundable. You acknowledge and agree that we are not required to provide a refund to you for any reason, and that you will not receive any money or other compensation for unused virtual items when we stop offering and/or supporting any ALPSE Services available to you.
7. Orders and Payment
The prices for and the amounts and kinds of Virtual Items and Virtual Currency available may be changed at any time without notice. Virtual Items and Virtual Currency that you receive may also be changed or discontinued at any time without notice.
Virtual Items and Virtual Currency may never be redeemed by you for "real world" money, goods, wares, merchandise, services, or anything of monetary value from ALPSE or any other person.
If you are under 18 years of age or under the legal age of majority to access the ALPSE Services, you agree that you may only make payments with the consent of your legal representative and if your legal representative has read and read the content. you represent that you understand and you agree to these Terms.
You understand and agree that ALPSE provides no refunds for any purchases except only as expressly stated in these Terms.
There is a limit on the amount of Virtual Currency that you may use, as specified below. If Virtual Currency is provided in excess of the maximum amount due to your having selected or entered incorrect information regarding your age, ALPSE will not be able to refund for the amount in excess:
  • Customers under the age of 16 years old: Up to 5,000 Japanese yen (equivalent) per month
  • Customers between the ages of 16 and 17 years old: Up to 20,000 Japanese yen (equivalent) per month
Notwithstanding the foregoing, the previous two clauses regarding spending limits and any refund restrictions may not be applicable depending on the region where a user resides, a user's age, and/or the Payment Processor.
If you were a minor at the time of accepting these Terms and use the ALPSE Services after reaching adulthood, you are deemed to have consented to all agreements relating to the use of the ALPSE Services through the continued use of the ALPSE Services
When you use Virtual Currency to obtain Virtual Items (such as skins, characters, or other in-game content), such Virtual Items are considered content provided to you upon the immediate use of your Virtual Currency.
The service for such Virtual Items is deemed fully performed and completed at the moment the exchange occurs. Regardless of the remaining period of the ALPSE Services or your Account status, Virtual Items have no monetary value and are not considered "Prepaid Payment Instruments" or "Store of Value" under applicable laws. Consequently, Virtual Items are non-refundable and cannot be converted back into Virtual Currency or real-world money, except as otherwise required by mandatory local law.
8. Prohibitions
You agree not to do any of the following while using the ALPSE Services or using the ALPSE Content or User Content:
  • 1) Violating the Terms
  • 2) Abuse or exploit a bug, glitch or mechanism in the ALPSE Services
  • 3) Access, tamper with, or use non-public areas of the ALPSE Services, ALPSE's computer systems, or the technical delivery systems of ALPSE's providers
  • 4) Post, transmit, promote, or distribute illegal content.
  • 5) Harass, threaten, abuse, disparage, libel, slander, embarrass, or engage in any other disruptive behavior involving another user or ALPSE or affiliate's employee or agent.
  • 6) Transmit or facilitate distribution of content that is harmful, abusive, racially or ethnically offensive, vulgar, sexually explicit, defamatory, infringing, invasive of personal privacy or publicity rights, or in a reasonable person's view, objectionable.
  • 7) Infringe upon the intellectual property rights of ALPSE or any third party.
  • 8) Disrupt the flow of chat in chat rooms, forum or other communication areas within the ALPSE Services, "spamming" or posting repetitive text.
  • 9) Impersonate another person, indicate that you are a ALPSE or affiliate employee or agent, or attempt to mislead users by indicating that you represent ALPSE or any of ALPSE's licensors or affiliates.
  • 10) Attempt to get Account, password, or other user information, or any other private information from a user.
  • 11) Upload any content that you do not own or have the right to freely distribute.
  • 12) Engage in or promote or encourage any illegal or fraudulent activity including hacking, cracking or distribution of counterfeit software, or identity theft.
  • 13) Upload files or display URLs that contain a virus or corrupted data.
  • 14) Post messages for any purpose other than personal communication, including, without limitation, advertising, promotional materials, chain letters, and pyramid schemes.
  • 15) Interfere with, hack into or decipher any transmissions to or from the servers running the ALPSE Services.
  • 16) Do anything that interferes with the ability of other users to enjoy the ALPSE Services or that materially increases the expense or difficulty of ALPSE in maintaining the ALPSE Services for the enjoyment of all its users.
  • 17) Bully, harass or intimidate any User, or cause any User to experience inconvenience or other difficulties.
  • 18) Sell, purchase, gift or exchange Virtual Items for "real" money.
  • 19) Copy, sell, assign, lease, license or grant a security interest in ALPSE Service or any part thereof (including ALPSE Materials and Virtual Items).
  • 20) Modify or remove any copyright, patent, confidentiality, and other notices, labels or legends in the ALPSE Services.
  • 21) Attempt (or authorize, encourage or support others' attempts) to circumvent, reverse engineer, decrypt, break or otherwise alter or interfere with the ALPSE Services or any component thereto.
  • 22) Other acts that ALPSE deems inappropriate, such as using the Service for a purpose different from the intended use of the ALPSE Services.
  • 23) Use the Account of another user, hold multiple Accounts, or share an Account between multiple people without the permission of ALPSE.
  • 24) Facilitate the raising of a ranking of a user or the acquisition of prizes in the ALPSE Services by intentionally disconnecting the network during online play or repeatedly losing to certain other users.
  • 25) Commit any act that induces or promotes suicide or drug abuse.
  • 26) Induce or solicit others to commit antisocial acts, or provide benefits to or cooperate with antisocial forces.
  • 27) Engage in political or religious activities, or solicit people to join political or religious organizations.
  • 28) Acquire, disclose, falsify, or leak information that can identify specific individuals (e.g., names, titles, telephone numbers, email addresses, addresses, location information, etc.), or the non-public information, trade secrets, or confidential information of companies, organizations, etc., without permission.
  • 29) Solicit or invite, while within the ALPSE Services, users to use other services (except as approved by ALPSE).
  • 30) Provide links with the intention of promoting an act that is prohibited under these Terms.
  • 31) Make unreasonable inquiries or requests to ALPSE (e.g., unnecessarily repeating a question or similar questions).
If you fail to comply with the Terms, ALPSE will immediately terminate the ALPSE Services without notice to you. In addition, if ALPSE determines that it is necessary, we may disclose and provide usage information without your permission to an organization with authority recognized by applicable laws and ordinances. You shall not be able to raise any objections to such measures or responses.
9. Disclaimers
The ALPSE Services is provided as is, without warranty of any kind, either express or implied. Without limiting the foregoing, ALPSE explicitly disclaims any warranties of merchantability, fitness for a particular purpose, quiet enjoyment or non-infringement, and any warranties arising out of course of dealing or usage of trade.
ALPSE makes no warranty regarding the quality of any products, services or content purchased or obtained through the ALPSE Services or the accuracy, timeliness, truthfulness, completeness or reliability of any content obtained through the ALPSE Services.
ALPSE does not guarantee that your registered information, including Virtual Items and Virtual Currency, from your previous device will be transferred to a new device when you replace the device due to repair or model change, except in cases where ALPSE specifically specifies otherwise.
ALPSE shall bear no obligation to repair bugs in the ALPSE Services, to improve the ALPSE Services, or to respond to or take any action in response to any inquiries, ideas for improvement, or other suggestions or feedback from you.
You agree that Virtual Items and Virtual Currency have no cash value and that ALPSE has no obligation to exchange them for anything of value. If your Account is terminated or suspended, Virtual Items and Virtual Currency shall have no value.
You may be able to access the ALPSE Services via third-party services (e.g., Apple, Google, Facebook).
  • You shall comply with the terms and conditions of such third-party services.
  • ALPSE shall not be responsible for any loss or damage resulting from your use of such third-party accounts, including but not limited to, login failures, data loss, or service interruptions caused by the third-party platforms.
10. Limitation of Liability
You acknowledge and agree that, to the maximum extent permitted by law, the entire risk arising out of your access to and use of the ALPSE Services and user content therein remains with you.
Neither ALPSE nor any other party involved in creating, producing, or delivering the ALPSE Services will be liable for any incidental, special, exemplary or consequential damages, including lost profits, loss of data or loss of goodwill, service interruption, computer damage or system failure or the cost of substitute products or services.
In no case shall the liability of ALPSE or its licensors, affiliates, employees, officers, or directors (collectively, the "ALPSE affiliates") to you be limited to the lesser of: (a) the total amount paid by you to ALPSE through your use of the ALPSE services the total amount paid by you to ALPSE through your use of the ALPSE Services or (b) US$100.00.
Some jurisdictions don't allow the exclusion or limitation of liability of consequential or incidental damages, and so the above limitation may not apply to you.
11. Advertisements
ALPSE shall reserve the right to post the advertisements of ALPSE or a third party in the ALPSE Services at the discretion of ALPSE.
12. Force Majeure
ALPSE is not and shall not be liable for any failure to perform its obligations hereunder due to external, unforeseeable, and irresistible circumstances, such as natural disasters, war, terrorism, riots, cyber attacks, fire, floods, network infrastructure failures, strikes, or pandemics.
13. Third-Party Disclaimer
The Service may contain services or content provided by third parties other than ALPSE. Such third parties shall bear any and all responsibility regarding such services and/or content. Furthermore, there may be terms of use or other terms and conditions provided by such third party which are applicable to such services and Content.
14. Privacy policy
ALPSE is committed to respecting your privacy and the confidentiality of your personal data. The Privacy Policy sets out how ALPSE may use your personal data, the traffic data and the content contained in your communication(s).
15. Export compliance
Software that is part of the ALPSE Services may be subject to United States export controls, and export controls of other jurisdictions. By accepting this Agreement, You warrant that You are not located in any country, or exporting software to any person or place, to which the United States or any other jurisdiction has embargoed the ALPSE Services or any element thereof. You further agree to abide by United States and other applicable export control laws and not to transfer, by electronic transmission or otherwise, any ALPSE Service restricted under such laws to a national destination prohibited by such laws, without first obtaining, and then complying with, any necessary government authorization. You further agree not to upload to the ALPSE Services any data or software that cannot be exported without prior written government authorization, including, but not limited to, certain types of encryption software. The assurances and commitments in this Section shall survive termination of this Agreement.
16. Governing law and Jurisdiction
1) General:
The laws of Japan, without regard to conflicts of law provisions, will apply to all matters arising out of or in connection with the ALPSE Services and your access use thereof.The United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded. Except as set forth in Section (b) below, you submit and consent to the exclusive jurisdiction of the Tokyo District Court located in Tokyo, Japan with respect to any dispute or cause of action arising out of or in connection with these Terms and the ALPSE Services.
Please note that the choice of law and jurisdiction set forth in this section may not be applicable to you depending on the mandatory consumer protection laws of the region where you reside.
2) For Residents of the United States:
The following shall apply in place of Section (a):
This Agreement is governed by the laws of Japan. However, any disputes not subject to the arbitration provision below shall be resolved by the Tokyo District Court.
1) New Jersey's TCCWNA Notice:
Under the New Jersey Truth-in-Consumer Contract, Warranty, and Notice Act ("TCCWNA"), please note the following:
  • 1. The limitations of liability and waiver of damages in Section 10 are not applicable to New Jersey residents.
  • 2. The indemnification requirements in Section 7 are not applicable to New Jersey residents.
  • 3. The provisions limiting a Customer's right to a return or refund in Section 7 and Section 8 are applicable to New Jersey residents.
2) Agreement to Arbitrate:
YOU AND ALPSE AGREE THAT ANY DISPUTE WILL BE DECIDED BY BINDING ARBITRATION ON AN INDIVIDUAL BASIS. YOU WAIVE THE RIGHT TO A JUDGE OR JURY AND THE RIGHT TO PROCEED IN A CLASS ACTION. All Disputes shall be exclusively submitted to JAMS (www.jamsadr.com) for binding arbitration under the Federal Arbitration Act.
17. Notification
For notifications from ALPSE to Users regarding the Service, ALPSE will use a method that ALPSE considers appropriate, such as posting in an appropriate place within the ALPSE Services.
18. Contact
For notifications from Users to ALPSE regarding the Service, Users shall use the customer inquiry form available on the Service or on ALPSE's website, or through other means designated by ALPSE.
19. Miscellaneous
If any provision of these Terms, and/or Additional Terms is held to be invalid or unenforceable, that provision will be deemed to be restated to reflect as nearly as possible the original intention in accordance with applicable law, and the remainder of the Terms, and/or Additional Terms will remain in full force and effect.

The Terms constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter.
Nothing in the foregoing sentence shall exclude or restrict the liability of you arising out of fraud or fraudulent misrepresentation. Any waiver of any provision of the Terms will be effective only if in writing and signed by ALPSE. The failure of the party to assert any right under these Terms shall not be considered a waiver of that party's right will remain in full force and effect.
The Terms, including ALPSE's enforcement of those policies, are not intended to confer, and do not confer, any rights or remedies upon any person.
The original English version of these Terms may have been translated into other languages. In the event of inconsistency or discrepancy between the Japanese version and any other language version, the Japanese language version shall prevail.
You are not allowed to assign the Terms or any rights hereunder. ALPSE is allowed at its sole discretion to assign the Terms or any rights hereunder to any third party, without giving prior notice to you.
20. Consumer's Rights
For residents of California, the following shall apply:
Under California Civil Code Section 1789.3, residents of California are entitled to the following specific consumer rights notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 400 R Street, Suite 1080, Sacramento, California, 95814, or by telephone at (916) 445-1254 or (800) 952-5210.

ALPSE, its licensors and/or certain third parties (as applicable) retain exclusive right, title and interest (including all intellectual property rights) in and to all materials that are part of the ALPSE Services (including past, present and future versions) (excluding User Content), including, without limitation: graphics; layout; text; images; audio and/or video; designs; advertising copy; logos; domain names; trade names and marks; and service marks; any and all copyrightable material; the compilation, assembly and arrangement of the materials of the Applications; and all other materials or content made available on the Applications (collectively, the "ALPSE Materials") and such ALPSE Materials are protected from unauthorized use, copying and dissemination by copyright, trademark, patent, publicity and other laws, rules, regulations and international treaties.
5. Fees and Withdrawal
You must pay the applicable fee for each the ALPSE Services and any available Virtual Items.
In addition to the foregoing, you hereby acknowledge and agree that you shall solely be responsible for and bear all telecommunication expenses, including, telephone charges, Internet connection charges and electricity charges, arising out of your access and use of ALPSE Services.
Any dispute arising between you and any third party payment process service (including a credit card company) shall be resolved directly between you and such third party. To the full extent permitted under applicable law, ALPSE shall not be liable for any obligations incurred by you to such third party in connection with your access and use of ALPSE Services. You agree to indemnify, defend and hold harmless ALPSE, its licensors, affiliates, employees, officers, and directors from all claims for liabilities, losses and expenses, including reasonable attorneys' fees, from third parties arising from such disputes.
Without limiting any other remedies, we may limit, suspend, terminate, modify or delete your access and use of ALPSE Services (or any portion thereof) at any time if you are, or we suspect that you are, failing to comply with any of with or without notice to you.
  • 1) If a person under the age of 18 or whatever is the age of legal majority where the area to live in does not have consent to a legal representative.
  • 2) If you have been disqualified from membership in the past.
  • 3) If a member violates the Terms.
  • 4) If ALPSE deems it inappropriate.
If ALPSE terminates your access to ALPSE Services, you may lose your Account as well as any benefits, privileges, Virtual Items and User Content associated with the subject ALPSE Services, and we are under no obligation to compensate you for any such losses or results.
All fees and charges you incurred in purchasing virtual items are non-refundable. You acknowledge and agree that we are not required to provide a refund to you for any reason, and that you will not receive any money or other compensation for unused virtual items when we stop offering and/or supporting any ALPSE Services available to you.
For residents of South Korea, notwithstanding any other provision in this section, you may cancel any Fee-Based Service and demand a refund within seven (7) days from the purchase date or the start date of the service, unless:
  • 1. The product is lost or damaged due to your fault.
  • 2. You have already used or partially consumed the product.
  • 3. The resale value is significantly diminished due to the passage of time.
  • 4. The packaging of a reproducible product is damaged.
  • 5. Other reasons stipulated by law for secure transactions apply.
In cases where points 2 through 4 above apply, ALPSE will ensure your rights are protected by clearly indicating such restrictions on the product packaging/interface or providing a test sample.
6. Orders and Payment
The prices for and the amounts and kinds of Virtual Items and Virtual Currency available may be changed at any time without notice. Virtual Items and Virtual Currency that you receive may also be changed or discontinued at any time without notice.
Virtual Items and Virtual Currency may never be redeemed by you for "real world" money, goods, wares, merchandise, services, or anything of monetary value from ALPSE or any other person.
If you are under 18 years of age or under the legal age of majority to access the ALPSE Services, you agree that you may only make payments with the consent of your legal representative and if your legal representative has read and read the content. you represent that you understand and you agree to these Terms.
You understand and agree that ALPSE provides no refunds for any purchases except only as expressly stated in these Terms.
For residents of France, Germany, Spain, Italy, and the United Kingdom, the following Right to Withdrawal applies:
Right to Withdrawal and Expiration for Digital Content: You have the right to withdraw from any purchase within 14 days without giving any reason, and the withdrawal period will expire after 14 days from the day you enter the contract for any purchase. However, by purchasing digital content, you agree that the content will be immediately available, and thereby you agree to waive your automatically granted statutory right of withdrawal.
For residents of South Korea, if the contents of a Fee-Based Service differ from the labeling, advertisement, or terms of the agreement, you may cancel the service within three (3) months of the purchase/start date, or thirty (30) days from the date you realized (or could have realized) the discrepancy.
Upon such cancellation, ALPSE shall withdraw the service and refund the payment within three (3) business days. If the service was partially consumed, ALPSE may deduct the value of the consumed portion from the refund.
7. Prohibitions
You agree not to do any of the following while using the ALPSE Services or using the ALPSE Content or User Content:
  • 1) Violating the Terms
  • 2) Misrepresenting your age or other eligibility information.
  • 3) Abuse or exploit a bug, glitch or mechanism in the ALPSE Services
  • 4) Access, tamper with, or use non-public areas of the ALPSE Services, ALPSE's computer systems, or the technical delivery systems of ALPSE's providers
  • 5) Post, transmit, promote, or distribute illegal content.
  • 6) Harass, threaten, abuse, disparage, libel, slander, embarrass, or engage in any other disruptive behavior involving another user or ALPSE or affiliate's employee or agent.
  • 7) Transmit or facilitate distribution of content that is harmful, abusive, racially or ethnically offensive, vulgar, sexually explicit, defamatory, infringing, invasive of personal privacy or publicity rights, or in a reasonable person's view, objectionable.
  • 8) Infringe upon the intellectual property rights of ALPSE or any third party.
  • 9) Disrupt the flow of chat in chat rooms, forum or other communication areas within the ALPSE Services, "spamming" or posting repetitive text.
  • 10) Impersonate another person, indicate that you are a ALPSE or affiliate employee or agent, or attempt to mislead users by indicating that you represent ALPSE or any of ALPSE's licensors or affiliates.
  • 11) Attempt to get Account, password, or other user information, or any other private information from a user.
  • 12) Upload any content that you do not own or have the right to freely distribute.
  • 13) Engage in or promote or encourage any illegal or fraudulent activity including hacking, cracking or distribution of counterfeit software, or identity theft.
  • 14) Upload files or display URLs that contain a virus or corrupted data.
  • 15) Post messages for any purpose other than personal communication, including, without limitation, advertising, promotional materials, chain letters, and pyramid schemes.
  • 16) Interfere with, hack into or decipher any transmissions to or from the servers running the ALPSE Services.
  • 17) Do anything that interferes with the ability of other users to enjoy the ALPSE Services or that materially increases the expense or difficulty of ALPSE in maintaining the ALPSE Services for the enjoyment of all its users.
  • 18) Bully, harass or intimidate any User, or cause any User to experience inconvenience or other difficulties.
  • 19) Sell, purchase, gift or exchange Virtual Items for "real" money.
  • 20) Copy, sell, assign, lease, license or grant a security interest in ALPSE Service or any part thereof (including ALPSE Materials and Virtual Items).
  • 21) Modify or remove any copyright, patent, confidentiality, and other notices, labels or legends in the ALPSE Services.
  • 22) Attempt (or authorize, encourage or support others' attempts) to circumvent, reverse engineer, decrypt, break or otherwise alter or interfere with the ALPSE Services or any component thereto.
  • 23) Other acts that ALPSE deems inappropriate, such as using the Service for a purpose different from the intended use of the ALPSE Services.
  • 24) Use the Account of another user, hold multiple Accounts, or share an Account between multiple people without the permission of ALPSE.
  • 25) Facilitate the raising of a ranking of a user or the acquisition of prizes in the ALPSE Services by intentionally disconnecting the network during online play or repeatedly losing to certain other users.
  • 26) Commit any act that induces or promotes suicide or drug abuse.
  • 27) Induce or solicit others to commit antisocial acts, or provide benefits to or cooperate with antisocial forces.
  • 28) Engage in political or religious activities, or solicit people to join political or religious organizations.
  • 29) Acquire, disclose, falsify, or leak information that can identify specific individuals (e.g., names, titles, telephone numbers, email addresses, addresses, location information, etc.), or the non-public information, trade secrets, or confidential information of companies, organizations, etc., without permission.
  • 30) Solicit or invite, while within the ALPSE Services, users to use other services (except as approved by ALPSE).
  • 31) Provide links with the intention of promoting an act that is prohibited under these Terms.
  • 32) Make unreasonable inquiries or requests to ALPSE (e.g., unnecessarily repeating a question or similar questions).
If you fail to comply with the Terms, ALPSE will immediately terminate the ALPSE Services without notice to you. In addition, if ALPSE determines that it is necessary, we may disclose and provide usage information without your permission to an organization with authority recognized by applicable laws and ordinances. You shall not be able to raise any objections to such measures or responses.
8. Disclaimers
The ALPSE Services is provided as is, without warranty of any kind, either express or implied. Without limiting the foregoing, ALPSE explicitly disclaims any warranties of merchantability, fitness for a particular purpose, quiet enjoyment or non-infringement, and any warranties arising out of course of dealing or usage of trade.
ALPSE makes no warranty regarding the quality of any products, services or content purchased or obtained through the ALPSE Services or the accuracy, timeliness, truthfulness, completeness or reliability of any content obtained through the ALPSE Services.
ALPSE does not guarantee that your registered information, including Virtual Items and Virtual Currency, from your previous device will be transferred to a new device when you replace the device due to repair or model change, except in cases where ALPSE specifically specifies otherwise.
ALPSE shall bear no obligation to repair bugs in the ALPSE Services, to improve the ALPSE Services, or to respond to or take any action in response to any inquiries, ideas for improvement, or other suggestions or feedback from you.
You agree that Virtual Items and Virtual Currency have no cash value and that ALPSE has no obligation to exchange them for anything of value. If your Account is terminated or suspended, Virtual Items and Virtual Currency shall have no value.
9. Limitation of Liability
You acknowledge and agree that, to the maximum extent permitted by law, the entire risk arising out of your access to and use of the ALPSE Services and user content therein remains with you.
Neither ALPSE nor any other party involved in creating, producing, or delivering the ALPSE Services will be liable for any incidental, special, exemplary or consequential damages, including lost profits, loss of data or loss of goodwill, service interruption, computer damage or system failure or the cost of substitute products or services.
In no case shall the liability of ALPSE or its licensors, affiliates, employees, officers, or directors (collectively, the "ALPSE affiliates") to you be limited to the lesser of: (a) the total amount paid by you to ALPSE through your use of the ALPSE services the total amount paid by you to ALPSE through your use of the ALPSE Services or (b) US$100.00.
Some jurisdictions don't allow the exclusion or limitation of liability of consequential or incidental damages, and so the above limitation may not apply to you.
For residents of France, Germany, Spain, Italy, and the United Kingdom, the limitations of liability and waiver of damages set forth in this section are not applicable. Furthermore, subject to certain exceptions under applicable consumer law:
  • 1) You may be entitled to a refund if Services are not as described or of satisfactory quality
  • 2) You may be entitled to a repair of your Device or compensation if you can show the fault of the Services has damaged the Device and ALPSE did not use reasonable care and skill
10. Advertisements
ALPSE shall reserve the right to post the advertisements of ALPSE or a third party in the ALPSE Services at the discretion of ALPSE.
11. Force Majeure
ALPSE is not and shall not be liable for any failure to perform its obligations hereunder due to external, unforeseeable, and irresistible circumstances, such as natural disasters, war, terrorism, riots, cyber attacks, fire, floods, network infrastructure failures, strikes, or pandemics.
12. Third-Party Disclaimer
The Service may contain services or content provided by third parties other than ALPSE. Such third parties shall bear any and all responsibility regarding such services and/or content. Furthermore, there may be terms of use or other terms and conditions provided by such third party which are applicable to such services and Content.
13. Privacy policy
ALPSE is committed to respecting your privacy and the confidentiality of your personal data. The Privacy Policy sets out how ALPSE may use your personal data, the traffic data and the content contained in your communication(s).
14. Export compliance
Software that is part of the ALPSE Services may be subject to United States export controls, and export controls of other jurisdictions. By accepting this Agreement, You warrant that You are not located in any country, or exporting software to any person or place, to which the United States or any other jurisdiction has embargoed the ALPSE Services or any element thereof. You further agree to abide by United States and other applicable export control laws and not to transfer, by electronic transmission or otherwise, any ALPSE Service restricted under such laws to a national destination prohibited by such laws, without first obtaining, and then complying with, any necessary government authorization. You further agree not to upload to the ALPSE Services any data or software that cannot be exported without prior written government authorization, including, but not limited to, certain types of encryption software. The assurances and commitments in this Section shall survive termination of this Agreement.
15. Governing law and Jurisdiction
1) General:
The laws of Japan, without regard to conflicts of law provisions, will apply to all matters arising out of or in connection with the ALPSE Services. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded. Except as set forth in Section (b) and (c) below, you submit and consent to the exclusive jurisdiction of the Tokyo District Court in Tokyo, Japan with respect to any dispute or cause of action arising out of or in connection with these Terms and the ALPSE Services.
2) For residents of France, Germany, Spain, Italy, and the United Kingdom, this section shall not prohibit you from bringing a claim or dispute against ALPSE in the country of your habitual residence
For residents of South Korea, the mandatory consumer protection laws of South Korea shall apply to the extent they provide greater protection than the laws of Japan, and you may bring claims in the competent courts of South Korea.
16. Notification
For notifications from ALPSE to Users regarding the Service, ALPSE will use a method that ALPSE considers appropriate, such as posting in an appropriate place within the ALPSE Services.
17. Contact
For notifications from Users to ALPSE regarding the Service, Users shall use the customer inquiry form available on the Service or on ALPSE's website, or through other means designated by ALPSE.
18. Miscellaneous
If any provision of these Terms, and/or Additional Terms is held to be invalid or unenforceable, that provision will be deemed to be restated to reflect as nearly as possible the original intention in accordance with applicable law, and the remainder of the Terms, and/or Additional Terms will remain in full force and effect.

Nothing in the foregoing sentence shall exclude or restrict the liability of you arising out of fraud or fraudulent misrepresentation. Any waiver of any provision of the Terms will be effective only if in writing and signed by ALPSE. The failure of the party to assert any right under these Terms shall not be considered a waiver of that party's right will remain in full force and effect.
The Terms, including ALPSE's enforcement of those policies, are not intended to confer, and do not confer, any rights or remedies upon any person.
The original English version of these Terms may have been translated into other languages. In the event of inconsistency or discrepancy between the English version and any other language version, the English language version shall prevail.
You are not allowed to assign the Terms or any rights hereunder. ALPSE is allowed at its sole discretion to assign the Terms or any rights hereunder to any third party, without giving prior notice to you.
